By 6 April 2020, employers will be expected to make a number of changes to the written statements of terms or particulars of employment that they provide to their staff, as required by section 1, Employment Rights Act (ERA).
Key changes to section 1 statements include:
- extending the obligation on employers to provide the section 1 statement to workers and not just employees;
- equiring most particulars in a section 1 statement to be provided on or before the start of employment as a ‘day 1 right’;
- including additional particulars in the section 1 statement (e.g. days of the week the employee or worker is required to work, details of variable hours, probationary periods, paid leave, other benefits and training); and
- removing any minimum service requirement so that all employees and workers will be entitled to a section 1 statement.
A: Interim staff are temporary employees used by businesses of all shapes and sizes for a set period or to manage certain projects. Often, interim staff fill a position on short notice and will have more flexible terms than permanent employees.
